Petitioner, Browning-Ferris, Inc. (BFI), seeks review of an order of the Environmental Hearing Board (Board) denying its petition to intervene in an appeal taken by Montgomery County from the Department of Environmental Resources' (DER's) conditional approval of Berks County's Municipal Solid Waste Management Plan (Plan). We will reverse the Board's order.1
