This is an action by the Federal Deposit Insurance Corporation ("FDIC"), as manager of the FSLIC Resolution Fund, seeking payment of a claim made under a fidelity bond issued by CNA Casualty of Puerto Rico ("the Underwriter") and for damages as a result of the Underwriter's alleged bad faith in adjusting the claim.
