This cause is before the Court on petition to review Ellis v. N.G.N. of Tampa, Inc.,561 So.2d 1209 (Fla. 2d DCA 1990), in which the Second District Court of Appeal held that no claim could be brought against an alcoholic beverage vendor for the alleged negligent sale of alcohol to a habitual drunkard, where there was no showing of a criminal violation.
