This appeal results from a class-action suit brought against certain members of the Commercial Fisheries Entry Commission (hereinafter CFEC) on behalf of Alaskan Natives who were unable to timely apply for limited entry fishing permits. Appellants, Gerald Riley, Richard Alto and Frank Alto, were excluded from the class after CFEC agreed to accept late applications from class members. On this appeal they challenge their exclusion...
