OPINION

GONZALEZ, Justice.

This is a suit for damages for personal injuries brought by a person shot by a taxi driver after a traffic accident. After a jury trial, the trial court rendered judgment n.o.v. for Greater Houston Transportation Co. d/b/a Yellow Cab Company of Houston, Inc. (Yellow Cab). The court of appeals, holding that Yellow Cab was guilty of negligence, reversed the judgment of the trial court and rendered judgment for the plaintiff.
