This case is before the Court on cross-motions for summary judgment, which have been fully briefed.

The plaintiff, Philip Agee, a United States citizen, complains that he has been denied a passport and that procedures provided by the Secretary of State with respect to his passport application violated the Constitution and federal statutes and regulations.
