While driving his 1976 Dodge pickup, Lawrence Sherman struck and killed two children. Sherman's insurer, National Indemnity Company (National), filed a declaratory judgment action in the United States District Court, District of Alaska, seeking a declaration that it did not provide coverage for the accident vehicle.
