Edward L. Smith was charged by bill of information filed August 27, 1981, with a violation of R.S. 40:969, to wit: possession of Talwin and Pentazocine. On June 14, 1982, a jury found the defendant guilty as charged. The court sentenced him to five years at hard labor and imposed a fine of $5,000.00. Under C.Cr.P.
