This is an appeal from the District Court for Boone County, Nebraska, in which the defendant was charged with and convicted of two felony counts, murder in the second degree and use of a firearm in the commission of a felony. He was sentenced to a term of 20 years on the second degree murder count and a consecutive term of 5 years on the offense of use of a firearm in the commission of a felony.
