CALOGERO, Justice.

On April 15, 1981, the grand jury of Bossier Parish returned a true bill, indicting defendant Earnest Knighton, Jr., for first degree murder in violation of La.R.S. 14:30. The twelve member jury unanimously found defendant guilty as charged. The bifurcated trial1 then continued, and the jury unanimously recommended the death penalty. In so recommending the jury found the existence of two aggravating circumstances
