Mr. LeVasseur was indicted on June 22, 1977, for having committed the offense of theft in the first degree, HRS § 708-831(1)(b) by removing two Atlantic Bottlenose dolphins (Kea and Puka) from the University of Hawaii marine laboratory at Kewalo Basin, Honolulu, Hawaii and placing them in the ocean off the Waianae coast of Oahu.
