The Secretary of Labor filed this lawsuit on December 27, 1977, alleging that defendant had violated Section 11(c)(1) of the Occupational Safety and Health Act (29 U.S.C. § 660(c)(1))1 by terminating the employment of Spencer Heard for refusing to work under allegedly unsafe conditions. The Secretary sought inter alia back pay with interest for Heard and an injunction against defendant's violations...
