Survivors (herein appellees) did not seek compensation under the Workers' Compensation Act, Chapter 386, Hawaii Revised Statutes. The Department of Labor and Industrial Relations initiated an investigation pursuant to its authority under Section 386-71, Hawaii Revised Statutes, after receiving a report of the accident from the employer.
