The State of California and the San Bernardino County Museum appeal the dismissal for failure to state a claim of their suit which sought to declare invalid a permit issued to the Smithsonian Institution under the Antiquities Act, 16 U.S.C. § 432, for removal and study of the "Old Woman Meteorite." They also appeal the denial of their motion for a preliminary injunction to enjoin removal of the meteorite from the State of California. We...
