WACHTLER, J.

The defendant has been convicted of felony murder for causing the death of Eileen Byrne during the course of a rape. The crime was committed on October 22, 1970. The defendant was arrested and charged with the offense on May 9, 1974. He was tried and found guilty by a Suffolk County jury in September, 1975.
