The plaintiffs, heirs-at-law of Rocco D'Agostino, deceased, appealed to the Superior Court from the admission of the decedent's will to probate. The plaintiffs claimed that the testator lacked sufficient testamentary capacity to execute the will, and that the will was the product of undue influence exerted upon the testator by the defendant.
