On or about August 31, 1972, the Pima County Grand Jury returned a six-count indictment against one Terry Paul Davis, the real party in interest in the instant case, and hereinafter appellant. At that arraignment, on September 5, 1972, appellant plead not guilty to five counts of burglary and one count of unlawful possession of marihuana.
