This is an action for damages resulting from personal injuries suffered by plaintiff Hickman through the alleged negligence of defendant Fairleigh and a corporate defendant Hoover Electric, not involved in this appeal. The case reaches us as a final judgment entered under Rule 54(b) in the form of a summary judgment granted by the District Court for the District of Kansas in favor of Fairleigh and against Hickman....
