This action was instituted by plaintiffs for a declaratory judgment that the provisions of Chapter 426 of the Private Acts of Tennessee, 1943, as amended, pertaining to the apportionment of the Rutherford County School Commission, violate rights secured to them by the Fourteenth Amendment of the Constitution of the United States and are, therefore, void.
