COLEMAN, Justice. Appellant was tried and convicted on an indictment which charged that he did carnally know, or abuse in the attempt to carnally know, a girl under the age of twelve years. § 398, Title 14, Code 1940. The jury found appellant guilty of an abuse of the girl in an attempt to carnally know her and fixed his punishment at imprisonment in the penitentiary for forty-five years. Motion for new trial was overruled...
