Blount County instituted condemnation proceedings against appellee to condemn 11.66 acres of land for highway purposes in the Law and Equity Court. Commissioners were appointed by that court and they awarded approximately $6,000 as damages. On appeal to Circuit Court, the case was tried by the court without a jury, under a stipulation that the only issue to be determined by the court was the amount of damages and compensation to be paid.
