PER CURIAM.

Appellant, Tom Gipson, was tried and convicted of murder in the second degree for the killing of E. C. Dyson, and was sentenced to twenty-five years in the penitentiary.

E. C. Dyson, the twenty-three year old deceased, his brother James, James' wife, their mother and father, another brother Travis and his wife (who was the daughter of Tom Gipson), all lived together about three miles from Columbia. On Sunday morning, December 20, 1953, James Dyson...
